Since communicating with you last, we have been in contact with the Department of Agriculture regarding their Appeal. The matter has been set down for hearing on the 9th and 10th of June 2005, and we have instructed Senior Counsel to prepare our opposition to this Appeal. We are optimistic that our legal team will be successful in persuading the Appeals Tribunal that the Appeal should be set aside.

The development, as you are aware, has the support of the Department of Local Government and Housing, who are responsible for planning in the province, the Provincial Department of Agriculture as well as the Department of the Environment.

We will keep you posted with regard to progress.

Tenders for the civil engineering contract closed last week, and an appointment of a contractor will be made immediately the Appeal has been dealt with. It is our intention to move on to site as soon as possible after Judgment has been granted.
