Dear Purchaser

We refer to our Newsletter of 9 June 2005 wherein we advised you of the intended High Court action herein. We confirm that the Court will hear the application on
1 July 2005 and that there are two possible conclusions, which are as follows: -

1. The Court decides in favour of the Garlington Development Trust and dismisses the National Department of Agriculture's appeal.
2. The other alternative is that the matter is referred back to the Development Tribunal where the National Department of Agriculture will submit their views to the Tribunal.

The National Department of Agriculture have in fact requested the court to grant this second option which is an order we ourselves have also requested. It is our understanding that should the matter be reviewed by the Development Tribunal, that the Tribunal may sit before the end of July 2005.

As soon as the Court's ruling is known we will advise you.
